**General Terms and Conditions and Conditions of Participation**

**Twelfth EBS Law Congress – November 27–28, 2025**

 

By purchasing a ticket, the purchaser accepts the following General Terms and Conditions of the ticketing service of the EBS Law Congress.

(hereinafter referred to as the “Organizer”)

### 1. General

 

1.1. These General Terms and Conditions (“GTC”) apply to participation and the related ticket sales for the above-mentioned event, organized by the above-named Organizer. Diverging terms and conditions of the participant shall not apply.

 

1.2. The Organizer reserves the right to make changes and additions to these regulations. Any changes or additions shall become valid upon publication on the event website: [www.ebs-lawcongress.de](http://www.ebs-lawcongress.de).

### 2. Registration and Conclusion of Contract

 

2.1. Registration for participation in the event is only possible via the EBS Law Congress website – specifically: [www.ebs-lawcongress.de](http://www.ebs-lawcongress.de).

 

2.2. The Organizer makes a binding offer to conclude a purchase agreement through the information provided on the website. The participant accepts this offer by completing the entire ordering process and clicking the “Complete Registration” button on the final checkout screen. Acceptance of the offer requires that all mandatory fields (marked with “\*”) are completed and these GTC are accepted.

 

2.3. The participation contract is concluded only once the Organizer has confirmed the registration via email. Any changes or additions to the contract must be made in writing. This also applies to the waiver of the written form requirement.

### 3. Prices

 

3.1. The price indicated in the registration confirmation is final and binding.

 

3.2. All prices include applicable VAT, where necessary.

 

3.3. If discounted rates (e.g., for students or members of certain organizations) are offered, they will be indicated separately. If no discounts are indicated, none will be granted. To qualify for a discount, a valid proof (e.g., student ID, university confirmation, or membership number) must be submitted upon request by the Organizer. Proof must be provided before the event begins. If not provided, the participant must pay the difference between the discounted and regular ticket price at the event to gain entry.

### 4. Payment

 

4.1. Payment must be made using the methods specified on the website. All fees are due immediately upon contract conclusion and no later than the day of the event.

 

4.2. **Payment by invoice:**

If payment is not received within 14 days of the invoice date, the Organizer may withdraw from the contract. In such cases, the participant loses the right to attend. Any transaction fees incurred must be borne by the participant.

 

4.3. **Credit card payment:**

When paying by credit card (MasterCard, Visa), participants will be prompted to enter their card details during the payment process. The credit card will then be charged the full ticket amount.

 

4.4. If a payment is reversed (e.g., due to insufficient funds), the participant must reimburse all resulting costs, including bank fees and a €10.00 handling fee per reversal.

Unjustified chargebacks will incur a €40.00 handling fee.

In such cases, the Organizer may withdraw from the contract, and the participant loses the right to attend. Additional claims by the Organizer remain unaffected.

### 5. Right of Withdrawal

 

5.1. **Right of Withdrawal**

**Right of Withdrawal:**

If the participant is a consumer under §13 BGB (German Civil Code), they may withdraw from the contract within 14 days without stating a reason, in writing (e.g., letter, email). To do so, participants must reference their ticket ID and contact:

The withdrawal period begins after receipt of this notice in written form, but not before the contract has been concluded and the Organizer’s obligations under Art. 246 §2 in conjunction with §1 (1) and (2) EGBGB and §312g (1) sentence 1 BGB in conjunction with Art. 246 §3 EGBGB have been fulfilled. Timely dispatch of the withdrawal notice suffices for compliance with the deadline.

 

**Consequences of Withdrawal:**

If the withdrawal is valid, both parties must return any received goods/services and any derived benefits (e.g., interest). If the participant cannot return the received performance (or only partially/with deterioration), they must compensate the Organizer accordingly. Refunds must be made within 30 days. This period starts with the dispatch of the withdrawal notice for the participant and with its receipt for the Organizer.

5.2. The right of withdrawal expires early if the Organizer begins performance with the participant’s explicit consent before the end of the withdrawal period or if the participant initiates the performance.

### 6. Cancellation

 

6.1. Cancellations are excluded, except where required by law.

 

6.2. If the registered participant is unable to attend, a replacement participant may be designated until **November 20, 2025, at 12:00 noon** by written notice or email to **[ressortleitung@ebs-lawcongress.de](mailto:ressortleitung@ebs-lawcongress.de)**.

### 7. Services

 

7.1. The scope of contractual services is defined by the information provided on the event website, registration forms, and the Organizer’s confirmation. In case of discrepancies, the booking confirmation is decisive.

 

7.2. Participants are entitled to remedies if services are not delivered as agreed. Complaints must be reported without delay. Claims for refunds due to clearly defective services must be submitted within 14 days after the event.

 

7.3. The Organizer reserves the right to replace speakers in exceptional cases. Participants will be informed of such changes in due time.

 

7.4. Travel, accommodation, and meals are not included unless explicitly stated in the event description. If the participant does not use offered services, no refund shall be granted.

### 8. Event Cancellation

 

8.1. The Organizer may cancel the event for urgent reasons with appropriate notice. This also applies to social or evening programs.

 

8.2. In case of cancellation, any payments made will be fully refunded within 14 days. Additional costs incurred by participants will not be reimbursed.

### 9. Copyright and Other Rights

 

9.1. Lectures and distributed materials are protected by copyright and may only be used for personal purposes. Usage rights are only granted through explicit written permission. Reproduction, distribution, editing, or public display of any kind is not permitted without written consent.

 

9.2. Audio or video recordings and public summaries (in whole or part) of the event or its content are not permitted.

### 10. Use of Coupon Codes

 

Only one coupon code may be used per purchase. If multiple coupons are used, only the one with the highest total value will be valid. The participant must pay the difference for any invalid codes applied.

### 11. Liability

 

11.1. The Organizer is liable

– for intent and any negligence in breaching essential contractual obligations. Liability is limited to the amount of the participation fee. Liability for indirect or financial damages (e.g., lost profit) is excluded.

– otherwise, only for damage caused by gross negligence or intent. In such cases, liability is also limited to the order amount. Liability for indirect or financial losses remains excluded.

 

11.2. These limitations do not apply to:

– claims under the Product Liability Act

– claims arising from fraudulent conduct

– liability for guaranteed features

– damages resulting from injury to life, body, or health

 

11.3. The Organizer and its agents are not liable for disruptions beyond their control.

 

11.4. Liability for damages during travel to/from the event venue or for loss and accidents is excluded to the extent permitted by law.

### 12. Final Provisions

 

12.1. German law applies exclusively, to the exclusion of the UN Convention on Contracts for the International Sale of Goods. Jurisdiction is Wiesbaden.

 

12.2. Should any provision of this contract be or become invalid, the remainder shall remain unaffected. A valid provision that comes closest to the intended purpose shall replace the invalid one. The same applies to contractual gaps.

 

12.3. Place of performance is the Organizer’s registered office.
